我国技术侦查措施立法的不足与完善

摘要
技术侦查写入到刑事诉讼法中,目的是将其向法制化方向转变。新刑事诉讼法的制定,使得侦查部门可以依法使用技术侦查措施,并将获得的证据直接作为诉讼证据使用。但新刑诉法技术侦查的规定存在局限,使得实际操作缺乏程序依据。立法上应通过规定技术侦查措施的适用原则、范围与条件,明确适用程序,规定救济途径等来进行完善。
Technical investigation is written into the Criminal Procedure Law with the aim of transforming it into the legalization.The formulation of the new Criminal Procedure Law enables the investigation department to use technical investigation measures according to law and use the obtained evidence directly as litigation evidence. However,the provisions on technical investigation in new criminal law are limited,which makes the actual operation lack of procedural basis. Legislation should be completed by stipulating the applicable principles,scope and conditions of technical investigation measures,clarifying the applicable procedures,and providing remedies.
