中国法治智库分析

摘要
[目的/意义]法治智库是中国特色新型智库的重要组成部分和法治中国建设的重要智力支撑,但却面临"库"重于"智"、"智"多于"质"的现实窘境,怎样建设法治智库成为学界关注的核心问题。[方法/过程]首先以认识论为基础,对其进行理论定位,包括法治智库的"智库属性"、"法治特质"、"法治智库在智库系统中边界互动关系"、"研究知识体系及功能架构"、"重要使命、发展类型模式和组织演化趋势"。其次,以实证研究为基础,借助"CTTI智库索引"提供的数据,从区域分布、研究领域、成果产出、组建形式等方面对其现状进行分析,但由于定位不清晰、机制运行不畅和人才缺陷等方面存在的不足,制约了法治智库的进一步发展。[结果/结论]以上分析表明,中国法治智库尚处于探索阶段,为了进一步推动其建设,笔者建议:国家应从宏观层面加强对其发展的整体设计,各法治智库应从中观层面完善相应的体制机制,从微观层面夯实人才基础。
[Purpose/Significance]The rule of law think tanks is an important part of the new type of think tanks with Chinese characteristics. Although it is an important intellectual support for the construction of the rule of law in China, it faces a bottleneck period in pursuing development in that presently "quantity" is more important than "intelligence", more "intelligence" and less "quality". Therefore, how to build rule of law think tanks has become a core issue of academic concern.[Method/Process]Based on epistemology, the author finds the theoretical position of the rule of law think tanks, including "think tanks attribute", "rule of law attribute", "the interaction of the rule of law think tanks in the think tank system", "the knowledge system and its corresponding functional framework", the important missions, type models and its organizational evolution. Second, based on the "CTTI think tank index", the paper analyzes the current situation from the aspects of regional distribution, research field, output of results, and form of formation and etc. However, due to the lack of clear positioning, poor operation of the mechanism and insufficient talents in the think tanks, the further development of the rule of law think tanks is restricted.[Result/Conclusion]The analysis shows that the Chinese rule of law think tanks is still in the exploration stage, to further promote the construction of the rule of law in China,it is suggested that: first, the state should strengthen the overall design of the development of the rule of law think tanks; second, the rule of law think tanks should improve the relevant institutional work systems and management mechanisms; and third, the rule of law think tanks should strengthen its human resources.
