构建北极区域治理制度性框架的法律问题研究

摘要
北极地区的争议纠纷错综复杂,其区域治理框架的构建涉及到一系列政治和法律层面的问题。在目前的诸多解决方案中,完善《联合国海洋法公约》和制定"北极条约"是眼下最为现实和合理的构想方案,但是又都存在着不足,需要进一步的改进。中国参与北极区域治理进程有其必然性和合法性,同时中国仍需进一步加强对北极地区的关注,通过积极参与北极区域治理框架的构建事务充分融入北极地区,以增强自身在北极区域和国际海洋法领域内的话语权。
The disputes in the Arctic Region are fully complicated. Its framework construction of regional governance involves a series of issues in the field of law and politics. The revision of The United Nations Convention on the Law of the Sea and the plan of the"Arctic Treaty"can be the most reliable and applicable to the arctic region among quite a few of current ones. However,there still exist defects and need to be improved. It's of necessity and validity for China's participation in the process of arctic regional governance,meanwhile China should actively get involved in the practices and the experiences of arctic regional governance,in order to enhance its discourse power on the legal issues integrated into the arctic and international marine affairs in the whole world.
