乡村振兴战略实施与宅基地“三权分置”改革的深化

摘要
宅基地"三权分置"改革是落实乡村振兴战略、保障农民安居乐业的基础平台和必要抓手,是未来一段时期内更有效呼应农业农村优先发展、满足乡村居民美好生活追求的关键制度创新。针对乡村振兴战略的发展要求,宅基地"三权分置"改革应当参照制度变迁的历史路径依赖,在坚持集体所有权不动摇的前提下进一步明确集体内涵、赋予完整权能、分离部分产权和强化公共职能;依据多元福利主义和福利实现依赖,以凸显资格权落实乡村农民集体的居住福利保障,并探讨由集体、政府、市场和社会共同提供多元农民居住福利保障替代路径;按照市场主导化配置和利益风险挂钩,以放活宅基地使用权实现资源市场配置优化和农民财产价值显化,并在利益诉求和可能风险之间权衡选择宅基地具体流转路径,实现宅基地由传统单一居住功能向现代多重复合功能转型。
The reform of the "three rights separation" of rural homesteads is the basic platform for implementing the rural revitalization strategy and ensuring peace and contentment of peasants' lives,and the vital institutional innovation to respond more effectively to the priority development of agriculture as well as the pursuit of better rural life in the near future. In response to the developmental requirements of the rural revitalization strategy, the reform of the "three rights separation" of rural homesteads should refer to the historical path dependence of institutional changes, and further clarify the collective connotation, integrated rights endowment, property rights separation, and public function reinforcement under the premise of insisting on collective ownership. Furthermore, the reform should highlight the membership right to stipulate the implementation of rural peasants' collective housing welfare coverage,and explore the alternative path of collective peasant housing welfare protection provided by the collective,government, market, and society based on Multiple Welfareism and welfare achievement dependence.Finally, the reform should realize the optimization of resource market allocation and the manifestation of farmers' property value by loosening the right of the rural residence land use according to the linkage between market-oriented allocation and interest risks, and choose the specific circulation path of the house site between interests appeal and possible risks to implement the transformation of traditional single residence function to modern multiple composite function of rural homesteads.
