亲属关系所产生的权利外观问题研究

摘要
表见代理制度是19世纪末立法者为了维护交易安全平稳而新创设的一种新型代理制度。亲属关系能否必然构成表见代理要件之权利外观越来越成为人们讨论的热门话题。针对此问题,应对亲属关系引起的权利外观进行类型化分析,进而认为应当综合考量行为人是否具有授权委托书、是否具有居间人确认行为人为有权处分或有权代理以及被代理人是否进行追认等三个方面来判断亲属关系所产生权利外观能否构成表见代理。
The agency by estoppel system was a new proxy system created by legislators in the late nineteenth century to maintain the security and stability of transactions. Whether the relationship between relatives can constitute the apparent appearance of the right of proxy is becoming a hot topic of discussion. In view of this problem, we should classify the right appearance caused by kinship. Then, it is considered that the three aspects of whether the perpetrator has the authorized letter of trust, whether the person has the intermediary confirmation of the right to dispose or have the right to represent and whether the agent is recognized, can judge the appearance of the right appearance of the kinship.
