从“宝马离婚案”看涉案公众人物隐私权的保护

摘要
近年来,公众人物涉法案件层出不穷,新闻媒体对涉案公众人物隐私的过度曝光及对案件的不实报道,在侵犯当事人隐私权的同时,也助长了网络暴力,阻碍了我国司法活动的正常进行。而我国对涉案公众人物隐私权的保护,目前还存在明显的不足和空白。从研究侵权途径的角度出发,分析我国对涉案公众人物隐私权的保护现状并反思其不足及漏洞,结合我国实际国情,从健全隐私权及网络信息监管立法、建立司法监督救济机制规范司法活动,完善新闻监管和审查制度等方面形成合力,共同阻断涉案公众人物隐私权的侵权途径。
In recent years, the cases of public figures breaking the law have increased obviously. The overexposure of the privacy of public figures who got involved in cases not only violated the rights of public figures but also foster the violence of Internet which outweighed the negative impact on general mood of society. The protection of privacy of public figures breaking the law is inadequate at present in China. It is high time that improving the legislation of privacy,mending the network and news supervision should get together.
