对外援助立法的必要性探析

摘要
我国国际经济地位的转变及"一带一路"倡议的推进要求扩大对外援助规模,但当前对外援助过程中产生的国内争议,表明对外援助行为及相应的援外实效需要依赖于援外制度建设及《对外援助法》的研究制定。《对外援助法》的制定是完善援外法律规范体系的重要步骤,是援外职能部门依法行政的基本前提,是援外制度普及与战略实现的最优选择,也是深化援外体制改革需求。对外援助存在的问题已不容回避,需要对外援助法律提供制度良方,我国应当及时启动《对外援助法》的研究、起草工作,服务"一带一路"与国际经济合作战略大局。
The transformation of China's international economic status and the promotion of "the Belt and Road"initiative calls for expanding the scale of foreign aid. The effectiveness of foreign aid depends on the construction of foreign aid institution and the formulation of foreign aid law. However, the domestic disputes arising from the current process of foreign aid show that the behavior of foreign aid and the corresponding effectiveness of foreign aid need to depend on the construction of foreign aid system and the study and formulation of the Foreign Aid Law. The formulation of Foreign Aid Law is an important step to improve the legal normative system of foreign aid, the basic premise for foreign aid functional departments to administer according to law, the best choice for the popularization of foreign aid system and the realization of strategy and the need for deepening the reform of foreign aid system. The problems existing in foreign aid can not be avoided. It is necessary to provide legal system and prescriptions for foreign aid. China should start the study and drafting of the Foreign Aid Law in a timely manner and serve the overall strategic situation of"the Belt and Road"and international economic cooperation.
