摘要

《生态环境损害赔偿制度改革方案》为推动建立生态(环境)损害赔偿法律机制提供了进一步试点的契机。我们须认识到,生态(环境)本身损害的避免须采取事先预防与事后救济并重的举措,而非为了赔偿而求偿,赔偿应以预防、遏制和修复(类似的)生态(环境)损害为目的。具有潜在生态(环境)损害重大致害风险的企事业单位是预防损害发生或扩大的第一位义务主体。因此,倡导尽快研究建立企事业单位预防生态(环境)损害发生的日常性预防机制,并相应建立政府主管部门的生态(环境)损害预防指导机制。
The Outline of Ecological Environment Compensation Reform opens up an opportunity to advance the establishment of a pilot system for ecological or environmental damage.We have to realize that in order to avoid any ecological or environmental damage,measures of prevention and remedy must be taken and`it is necessary to point out that claiming for compensation is not the purpose of damages.Instead,prevention,restriction and restoration of ecological or environmental damage should be the real aims of compensation.Enterprise who will potentially cause damage to ecosystem or environment should be the primary obligators to prevent ecological or environmental damage or the extension of it.Thus,it is sensible to initiate the establishment of a routine system for preventing ecological or environmental damage in the related enterprise as soon as possible,and also a guide system of ecological or environmental damage prevention by competent authorities.
