检察机关提起行政公益诉讼问题研究

摘要
2017年的《行政诉讼法》新增了检察机关提起行政公益诉讼的相关规定,标志着该制度在我国的正式确立。虽然公益诉讼在前几年的试点推行中取得了良好的效果,但是其仍处于起步阶段,发展尚不完善,检察机关在实际操作中面临着受案范围狭窄、线索来源单一、举证责任分配和配套机制不健全等诸多困境。为此需要适当扩大受案范围,增加多渠道线索来源,明确检察机关与行政机关的举证责任和权限等,以更好地完善行政公益诉讼制度。
n 2017,the Administrative Procedure Law added the relevant provisions of the procuratorial organs to initiate administrative public interest litigation,marking the formal establishment of the system in China. Although public interest litigation has achieved good results in the pilot implementation in the past few years,it is still in its infancy and its development is not perfect. In the practical operation,procuratorial organs are faced with many difficulties,such as narrow scope of accepting cases,single source of clues,distribution of burden of proof and imperfect supporting mechanism. Therefore,it is necessary to expand the scope of accepting cases,increase the sources of multi-channel clues,and clarify the burden and authority of proof of procuratorial organs and administrative organs,in order to better improve the administrative public interest litigation system.
