浅析电子数据收集提取的规范化

摘要
刑事诉讼中电子数据的收集和提取的规范化,是证据审查的重要内容。从审查判断电子数据的原则出发,针对电子数据的"三性":真实性、合法性、关联性,提出收集和提取过程中的完整性、客观性及其规则是真实性的最重要因素,通过案例介绍了手机短消息和即时通信聊天记录、撤回的微信视频以及网站数据的网络在线收集和提取的规范化。
The standardization of the collection and extraction of electronic data in criminal proceedings is an important part of evidence review. Starting from the principle of reviewing and judging electronic data, aiming at the "three characteristics" of electronic data: authenticity, legitimacy, and relevance, it is proposed that, in the process of collection and extraction, integrity, objectivity and their rules are the most important factors of authenticity. Through cases, it introduces the standardization of the collection and extraction of mobile phone short messages and instant communication chat records, withdrew We Chat videos and website data.
