论运动员的一般人格权及其限制

摘要
以民法基本理论为基础,结合实际,论述了一般人格权的内容和类型。作为具体人格权的补充,一般人格权以"兜底"的方式来保护民事主体的人格。运动员作为自然人,同样享有一般人格权,但是,基于体育运动特别是体育比赛的特殊性,运动员应当根据比赛规则或相关协会章程的规定谨慎行使该项权利。只有运动员的行为自由、人格尊严权的行使得到有效约束或限制,比赛的连贯性才能够得到确保,体育运动的正常秩序才能够运行顺畅。
Based on civil right law,the paper discusses the contents and types of general personality right.As the supplement of specific civil right,the general personality right protect the personality of the civil subject thoroughly.The athletes enjoy the general personality rights as natural human,but the athletes should apply this right according to competition rules or regulations of relative associations based on the special features of the sports competitions.Only when the behavior freedom and personality dignity of the athletes can be restricted,the consistency of the competition can be guaranteed and the sports competition can be carried out smoothly.
