国家监察体制改革进程中司法鉴定管理改革探究

摘要
国家监察体制改革将改变国家权力格局,被评价为中国近二十年来的重大政治改革。这一制度改革将深刻影响我国目前的司法体制,司法鉴定管理体制也必然会随之进行重大调整。改革初期,需协调并处理好监察委员会鉴定职权的执行问题、检察机关内设鉴定机构的管理问题以及改革后所面对的司法鉴定概念界定,司法鉴定管理类别,鉴定人、鉴定机构的准入与退出,司法鉴定启动权等问题。在国家监察体制改革实践中,建议加快研究制定《司法鉴定法》的步伐,通过系统化的立法来规范新体制下的司法鉴定运作,使司法鉴定管理体制适合且满足国家司法体制改革的需要。
The national supervision system reform, which is judged as China's major political reform over the past twenty years, will change the pattern of state power. The reform of the system will profoundly influence the current judicial system in our country, whereby the judicial appraisal management system is bound to undergo a major adjustment. At the beginning of the reform, it is necessary to coordinate and deal with some issues, such as the implementation of the appraisal authority of the supervisory commission, the management of the appraisal institutions set up by the procuratorial organs, the definition of the concept of judicial appraisal, the category of judicial appraisal management, the admission and exit of appraisers and appraisal institutions, and the initiation right of judicial appraisal. In the practice of the national supervision system reform,it is suggested to speed up the research and legislation of the Judicial Appraisal Law, to regulate the judicial appraisal operation under the new system through systematic legislation, and to make the judicial appraisal management system fit and meet the needs of the national judicial system reform.
