摘要

《民法总则》带来了许多创新元素,其中的绿色原则就具有丰富的可研究性。它作为一项政策性民法基本原则,背后不仅有相关法理作支撑,还能从宪法学中找到理论基础。文章从宏观的层面把握绿色原则,借助法律解释的方法和法律规则的行为模式解读该条款,梳理绿色原则的历史由来以及立法过程中的肯定与否定意见,解读绿色原则对民事主体权利加以限制的内涵,找到绿色原则的宪法基础。
        General Rules of Civil Law brings many innovative elements, among which the green principle, as basic principle of Civil Law, is supported with relevant theory of law and theoretical basis of constitution. The paper presents the green principle macroscopically, and interprets the item from legal interpretation and behavior pattern of legal regulation, and reviews the opinions of the green principle in the legislative process, and demonstrates the rationality of the green principle by constitution, and explains the connotation of the restriction of the green principle on civil subject right, and obtains constitutional basis of the green principle.
