审判中心主义视域下海上刑事执法研究

摘要
随着全国人大常委会通过决定的方式明确海警海上刑事执法权,海警机关行使刑事执法权有了明确法律授权。但由于当前海上刑事执法工作面临着海警刑事执法队伍建设缓慢、海上犯罪侦查取证难、海警与相关部门执法协作机制尚未建立等困境,需要通过完善海上刑事执法程序、提升海警刑事执法能力、建立海警与相关部门的执法协作机制、加强海警刑事执法保障等方式,共同促进海上刑事执法工作的提升,以适应审判中心主义改革要求,实现海上刑事法治。
With the decision of the Standing Committee of the National People's Congress to determine the criminal enforcement power of the maritime police at sea, the maritime police organs have legal authorization to exercise the power of criminal law enforcement. However, the construction of law enforcement team is slow, to investigate and collect evidence is difficult, law enforcement cooperation mechanism has not been established. To this end, it is necessary to improve the procedures of the maritime police criminal law enforcement, improve the maritime police criminal law enforcement capabilities, establish a law enforcement cooperation mechanism between the maritime police and relevant departments and strengthen the maritime police criminal law enforcement guarantee, etc. Through these measures, the criminal law enforcement can meet the requirements of judicial reform and maritime criminal rule of law can be realized.
