反腐败国际合作从联合侦查向自主侦查路径转变探讨

摘要
《联合国反腐败公约》鼓励各国以条约或个案形式开展联合侦查,联合侦查代表着合约国在特定情况下可以让渡部分司法权,但能否在此基础上更进一步,允许外国司法人员在本国范围内,相对独立地开展侦查活动,是国际刑事司法领域的一项新课题。结合刑事侦查活动的特性、国际反腐败实践和最新趋势,在不久的未来,有条件地开放司法权限制、允许外国司法人员一定限度内在我国直接开展侦查活动,将成为我国国际刑事司法合作领域的理性选择。
United Nations Convention against Corruption encourages state parties to conduct joint investigation under regulation of Convention or in form of individual cases. Joint investigation means state parties entrust part of their judicial authority to foreign judicial organ in certain circumstances. However,it is a new topic in the field of international criminal justice whether foreign judicial personnel can be allowed to conduct investigation individually within their own country. Considering features of criminal investigation activities,practice of worldwide anti-corruption and the latest trend,in the near future,it will be a rational choice for China to conditionally broaden the limits of judicial authority in the field of international criminal judicial cooperation and allow foreign judicial personnel to carry out investigation activities directly within a certain limit.
