新时代侦查概念体系的反思与重构

摘要
侦查是一项古老的职能活动,理清侦查概念是区分侦查职能活动与其他社会活动的基础。侦查在字形意义上和法律意义上的不同解读,决定了侦查模式、侦查程序、侦查功能、侦查价值的不同展开。通过历史考察和现实比较,结合中外立法司法实践,确证侦查的主体、目的、对象、内容等要素均在不断发展。建立具有中国特色的新时代侦查概念体系对于侦查理论研究和实践剖析具有极其重要的意义。
Investigation is an ancient functional activity. Screening the concepts of investigation is the basis of distinguishing between investigation functional activities and other social activities. Different interpretations of the investigation in the literal sense and in the legal sense determine the different development of the investigation mode, the investigation procedure, the investigation function, and the investigation value. Assuring the subjects, objects, and contents of investigation has been continuously developing through comparing the history and the reality, and practices between eastern and western countries. Establishing a new era investigation concept system with Chinese characteristics is of great significance for investigation theoretical studies and practice analyses.
