电信网络诈骗黑色产业链共治模式研究

摘要
以电信网络诈骗黑色产业链为研究对象,辨析犯罪产业和犯罪产业链的关系,介绍电信网络诈骗黑色产业链涵盖的上下游产业,以及电信网络诈骗犯罪黑色产业链在表现形式上呈现分工精细化、互为供求关系、犯罪手段升级迅速、跨国跨境犯罪特点,着重分析黑色产业链的成因在于公民个人信息泄露严重,实施犯罪成本低、犯罪收益大,电信和银行部门存在管理难题。针对成因提出了四条建议:一是构建保护公民个人信息机制;二是创新理念强化协作,完善立体化合作平台;三是金融部门和通信运营商应主动承担社会责任;四是构建公民反诈骗教育体系。以全链条打击模式和综合治理体系来压缩犯罪活动空间,从根本上遏制电信网络诈骗案件的高发。
Taking the black industry chain of telecommunication network fraud as the research object,this paper distinguishes the relationship between criminal industry and criminal industry chain,introduces the upstream and downstream industries covered by the black industry chain of telecommunication network fraud,and the characteristics of the black industry chain of telecommunication network fraud crime in its manifestation,such as fine division of labor,mutual supply and demand relationship,rapid upgrading of criminal means,transnational and cross-border crime,with emphasis on the analysis of black.The causes of industrial chain lie in the serious leakage of citizens' personal information,the low cost of committing crimes,the large profits of crimes,and the management problems of telecommunications and banking departments.In view of the causes,four suggestions are put forward:first,to construct a mechanism to protect citizens' personal information;second,to innovate ideas to strengthen cooperation and improve the three-dimensional cooperation platform;third,the financial sector and communication operators should take the initiative to assume social responsibility;fourth,to build a civic anti-fraud education system.To reduce the space of criminal activities by means of the whole chain attack mode and the comprehensive management system,and to curb the high incidence of telecommunication network fraud cases fundamentally.
