民事公益诉讼环境损害司法鉴定收费制度研究

摘要
生态环境已经成为公众高度关注的重要议题。然而对于旨在保障社会公共环境利益的环境民事公益诉讼而言,环境损害司法鉴定意见已成为环境民事公益诉讼中不可或缺的证据种类之一。但因目前环境损害司法鉴定收费标准的缺失和收费较高的现实,可能导致部分环境民事公益诉讼案件无法得到及时、有效的处理。对此,为进一步保障环境民事公益诉讼的顺利运行,在借鉴国外优秀经验基础之上,相关部门有必要从明确环境损害司法鉴定收费标准、完善环境损害司法鉴定法律援助、完善环境损害责任保险制度等方面,对环境损害司法鉴定收费制度进行完善。
The ecological environment has become an important topic of public concern. For environmental civil public interest litigation aimed at protecting the interests of the public and the public environment, environmental damages judicial appraisal has become one of the indispensable types of evidence in environmental civil public interest litigation. However,due to the current lack of fee schedule for environmental damages judicial assessment, and the relatively high fees, some environmental civil public interest litigation cases may not be processed in a timely and effective manner. In order to further ensure the smooth operation of environmental civil public interest litigation, taking reference of the experience of foreign countries, it is necessary for relevant departments to clarify the fee schedule of environmental damages judicial assessment,improve legal aid in environmental damages judicial appraisal, and improve the environmental damage liability insurance system. Thus the system of judicial assessment fees for environmental damages will be improved.
