大数据在侦查实战中存在问题及制度构建

摘要
大数据作为新技术在公安工作中正在被广泛的应用,提高了案件侦破效能。通过和传统侦查手段对比阐述了大数据在侦查实战中的应用价值,分析了其在具体使用过程中的特点,指出了在大数据热潮下所产生的一些思维误区,总结了在侦查应用中存在的一些问题。根据大数据应用的特点和公安侦查工作实际情况,制定了和大数据侦查工作相关的法律制度、行为管理规范和技术手段措施,对大数据应用的良好发展和法制化进程都提供了重要的指导意义。
Big Data, as a new technology, is widely used in public security work, which improves the efficiency of case detection. By comparing with traditional investigative methods, this paper expounds the application value of Big Data in actual investigative combat, analyses its characteristics in the specific use process, points out some thinking errors caused by the upsurge of big data, and summarizes some problems existing in the application of investigation. According to the characteristics of big data application and the actual situation of public security investigation work, the legal system, behavior management norms and technical measures related to big data investigation work are formulated, which provide important guiding significance for the good development of big data application and the process of legalization.
