治理创新与地方法治建设

摘要
建设法治国家离不开地方的具体实践,法治是地方治理创新的动力和源泉。在阐述地方治理创新内涵和影响因素的基础上,阐述法治是影响地方治理创新的第一位因素,并分析地方治理创新对地方法治建设的内在需求,提出强化法治建设提升地方法治水平,以法治保障地方治理创新举措,即:将法治作为最优地方社会治理手段、将法治作为地方社会治理行为的规范、将法治作为保证社会组织和公众有序参与的工具。
The construction of a country ruled by law cannot be separated from local practice,and the rule of law is the driving force and source of power for local governance innovation.This paper,based on the expounding of the connotation of the local governance innovation and the influence factors,proposes that the rule of law is the primary influencing factor for local governance innovation,analyzes the intrinsic demand of local governance innovation for the construction of local rule of law.It then puts forward to strengthen the rule of law construction to enhance the rule of law level,and the measures of guaranteeing local governance innovation by rule of law.The measures include with the rule of law guarantee local governance innovation measures,namely:the rule of law as a means of optimal local social governance,the rule of law as local social governance behavior norms,the rule of law as tool of guaranteeing social organization and orderly public participation.
